1. Acceptance

By accessing or purchasing products and services from CastPeak Studios LTD, including digital branding assets, production resources, templates, graphics, and other creative products, you agree to these Terms & Conditions and any additional policies referenced herein.

If you are purchasing or accessing our products on behalf of a company, podcast, team, or organization, you confirm that you have the authority to accept these Terms on its behalf.

These Terms constitute a legally binding agreement between you and CastPeak Studios LTD. If you do not agree with these Terms, you may not access or use our products or services.

2. License & Access

When you purchase a CastPeak digital product, we grant you a limited, non-exclusive, non-transferable license to use the purchased assets in accordance with the product description and these Terms.

Unless otherwise stated at the time of purchase:

  • You may download and use purchased digital assets for your own podcast, brand, channel, or creative projects.
  • You may use licensed assets in podcast artwork, episode graphics, thumbnails, social media content, websites, promotional materials, videos, and other permitted content.
  • You may modify assets where the purchased product or license permits customization.
  • You may not redistribute, resell, sublicense, or publicly share the original downloadable files.
  • You may not upload purchased assets to marketplaces, asset libraries, file-sharing services, or similar platforms for redistribution.
  • You may not claim CastPeak’s original assets as your own creation.
  • You may not remove copyright notices or other ownership information where such notices are included.
  • Team or business use is permitted only where the applicable license or purchase specifically allows it.
  • License terms may vary between products and will be stated in the applicable product description or purchase terms.

3. Account Responsibilities

If you create an account or provide information when purchasing from CastPeak, you are responsible for:

  • Credential security: Keeping your login credentials confidential and notifying us if you suspect unauthorized access.
  • Accurate information: Providing accurate and up-to-date contact, billing, and account information.
  • Responsible use: Using purchased assets in accordance with these Terms and the applicable license.
  • Compliance: Following applicable laws and regulations when using our products.
  • Payment obligations: Ensuring that purchases are authorized and payment information is accurate.

You must not share account credentials or provide unauthorized persons with access to products restricted to your account.

4. Payments & Billing

Unless otherwise stated, products are purchased through a one-time payment.

  • Prices are displayed on the applicable product or checkout page.
  • We reserve the right to change product prices at any time. Price changes will not affect completed purchases.
  • Promotional prices, discounts, and special offers may be subject to additional conditions.

All original CastPeak content, including branding concepts, graphics, templates, illustrations, production resources, website content, logos, text, and the CastPeak Studios LTD brand, is protected by applicable intellectual property laws.

Unless expressly stated otherwise:

  • Purchasing a product does not transfer ownership of CastPeak’s underlying intellectual property to you.
  • You receive only the license or usage rights described for the purchased product.
  • You may not resell, sublicense, distribute, or otherwise commercialize the original downloadable files as standalone assets.
  • You may not use CastPeak products to create a competing asset library or marketplace.
  • You may not represent CastPeak-created assets as entirely your own original work where doing so would misrepresent their source.
  • You may not create competing derivative products for resale based substantially on CastPeak assets without written permission.
  • Feedback, suggestions, or product ideas you provide may be used by CastPeak Studios LTD to improve its products and services without compensation, subject to applicable law.

6. Acceptable Use

To protect our customers, creators, and intellectual property, you agree to:

We do not guarantee that:

  • A particular branding asset will achieve a specific audience, marketing, business, or financial result.
  • Our website or digital products will always be available without interruption.
  • Digital products will be completely free from technical errors.
  • Every product will meet requirements that were not expressly stated in its product description.

You are responsible for ensuring that your use of purchased assets complies with applicable laws, platform rules, licensing requirements, and the terms of any third-party platforms where you publish your content.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded under applicable consumer law.

8. Limitation of Liability

To the fullest extent permitted by law, CastPeak Studios LTD will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services.

To the fullest extent permitted by applicable law, our aggregate liability arising from a particular purchase or service will generally be limited to the amount you paid for that purchase or service.

Upon termination or license cancellation:
